Seoul International Travel Mart for Medical Tourism seeks to obtain your consent to these Terms of Use and to the Collection and
Use of Personal Information before proceeding with your membership registration and allowing you to use our services.
Please read through the details carefully before agreeing to our terms.

Terms of Use (required)

Chapter 1. General Provisions

Article 1. Purpose
These Terms of Use aim to stipulate the rights, obligations, and responsibilities of users and of Seoul International Travel Mart for Medical Tourism (hereinafter "SITMMT"), as well as other necessary matters between them, in using the preliminary and on-site business matching services and other convenient services (hereinafter "Services") provided by SITMMT.

Article 2. Effect & Change of Terms of Use
① SITMMT shall notify these Terms of Use to users by posting them on the website or in other ways, and these Terms of Use shall take effect when users agree to them by signing up for the Services.
② SITMMT may change the details of these Terms of Use when deemed necessary, and in this case, shall make the changed Terms of Use available on the website so that users can view them for themselves.
③ Users may stop using the Services and cancel their registration if they disagree with the changed Terms of Use, but if they continue to use the Services, it will be deemed that they have agreed to the changes, and the changed Terms of Use shall take effect in the same way as in Paragraph 1.
④ If users agree to the details of these Terms of Use, the latter shall take precedence concerning the provision of service by SITMMT and the use of service by users. Matters not specified in these Terms of Use shall be governed by the Framework Act on Telecommunications, the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the deliberation regulations of the Korea Communications Standards Commission, the code of ethics for information and communication, the Programs Protection Act, and other applicable laws, regulations, and business practices of the Republic of Korea.

Article 3. Definitions
① The terms used in these Terms of Use shall be defined as follows.
1. User: A member accessing and receiving the Services provided by SITMMT
2. Member: A person who agrees to these Terms of Use by accessing the Services and has undergone SITMMT's confirmation process to receive an ID (unique identifier) and a password
3. ID (unique identifier): A combination of English letters and numbers selected by a user and accepted by SITMMT for member identification and service use
4. Password: A combination of letters, numbers, and special characters entered by the user to protect his/her member information
5. Termination of service: Expression of intent by SITMMT or a member who has been using the website to terminate the Service User Agreement
② Except as set forth in Paragraph 1, the terms used in these Terms of Use shall be governed by relevant laws and regulations and by guidelines specific to each service.

Chapter 2. Service User Agreement

Article 4. Establishment of Service User Agreement
The Service User Agreement is established when users agree to these Terms of Use and SITMMT approves their request to use the Services.

Article 5. Request for Service Use
Users can request to use the Services by accessing the Member Information page and entering the personal information SITMMT requires on the request form for registration.

Article 6. Approval & Rejection of Request for Service Use
① Unless there are special circumstances, SITMMT shall approve a request for service use if such request is made by accurately entering the details mentioned in Article 5.
② In any of the following cases, SITMMT may limit the use of certain services until the reason for such limitation is resolved.
1. If the information is found to be false (borrowed name, etc.) or there are reasonable grounds to suspect it
2. In other cases SITMMT deems it necessary
③ SITMMT may reject a request for service use in the following cases.
1. If requested under another person's name
2. If the details entered on the request form are false
3. If requested with an intent to disrupt social peace and order or harm public morals
4. If other requirements set forth by SITMMT to request service use are not met

Article 7. Change in Details of Agreement
Members may view and correct their information on the Manage Member Information page any time they want. If the information they entered when requesting service use has changed, they must correct it, and any problems arising from not doing so shall be their responsibility.

Chapter 3. Provision & Use of Services

Article 8. Use of Services
① SITMMT shall begin providing the Services from the time it approves a member's request for service use; provided, however, that certain services may only be offered as of a designated date.
② If SITMMT cannot begin providing the Services due to business or technical difficulties, it shall post the details on the website or send a notice to the members.
③ In principle, the Services shall be available 24/7; provided, however, that such service provision may be temporarily suspended for business or technical reasons of SITMMT or for operational purposes, such as regular inspections, during a period defined by SITMMT. In these cases, SITMMT shall post the details in advance or afterward.
④ Even after member registration, certain services may only be offered to specific members according to the requirements specified by the service provider.
⑤ SITMMT may divide the Services into different scopes and specify available hours for each scope. In this case, it shall post the details in advance.

Article 9. Change and Suspension of Services & Saving and Use of Information
① Members agree that SITMMT shall not be liable if information, such as messages saved in or sent through the website and other communication messages, are not saved, are deleted, or are not sent due to national emergencies, power outages, service facility failures outside the scope of SITMMT's management, and other events of force majeure. The same shall also apply to any other losses of communication data that are caused by the same reasons.
② If SITMMT has to temporarily suspend the Services due to difficulties in providing the Services normally, it may do so after notifying the details one (1) week before suspending the Services. It shall not bear responsibility for members' failure to become aware of such suspension during the given time. The advance notice period above may be reduced or omitted if there is a significant reason. SITMMT shall also not bear responsibility for the information, such as messages saved in or sent through the website and other communication messages, that are not saved, are deleted, or are not sent due to the suspension of the Services, as well as for any other losses of communication data that are caused by the suspension.
③ Paragraph 2 shall apply if the Services must be permanently suspended due to SITMMT's circumstances; provided, however, that in this case, the prior notice period shall be one (1) month.
④ SITMMT may temporarily modify, change, or suspend the Services after prior notice and shall not bear any responsibility to members or third parties for it.
⑤ SITMMT may arbitrarily suspend the use of the Services if a member acts in violation of these Terms of Use. In this case, it may prohibit the member's access and arbitrarily delete all or part of the contents posted by him/her.
⑥ For long-term dormant members, SITMMT may suspend their use of the Services after a notice period of one (1) week from sending them an email of notice or posting an announcement about it.

Article 10. Provision of Information & Posting of Advertisements
① SITMMT may provide members with various information and advertisements deemed necessary via email, letter, SMS (mobile text messages), DM, messenger, etc., while members use the Services, and if members receive unwanted information, they may refuse to accept the information.
② SITMMT may post advertisements on its website, emails, etc. as part of managing its website and deems that members who intend to use the Services agree to such posting of advertisements.
③ SITMMT shall not be held liable for any loss or damage caused by a member's engagement in promotional activities that are posted on the website or undertaken for advertisers through the website, or any loss or damage resulting from a member's communication or transaction thereof.

Article 11. Deletion of Posts or Contents
① SITMMT may delete, without prior notice, any content posted or registered by a member if it is deemed to fall under any of the following cases and shall not take any responsibility for this.
1. If the content slanders or discredits through slandering SITMMT, another member, or a third party
2. If the content violates public order and morals
3. If the content is found to be related to criminal activity
4. If the content infringes the copyright or other rights of a third party
5. If the information does not conform to the nature of the Services
6. If the content violates other relevant laws and regulations, or rules set by SITMMT
② SITMMT reserves the right to edit, move, or delete any content posted on the website after three (3) days of prior notice and may delete, without prior notice, any content that violates these Terms of Use; any commercial, illegal, or indecent content; and any content posted by a member who has canceled their registration.
③ If a posted content loses its effect as a post after a certain period of time and the purpose for maintaining it becomes unclear, SITMMT may delete the post after a notice period of one (1) week since it publicly announced the details.

Article 12. Copyright of Posts
① The copyright of contents posted by a member belongs to him/her, but SITMMT may post them on other services or utilize them otherwise.
② The civil and criminal responsibilities arising from a member's post infringing a third party's copyright, program copyright, etc., shall fully be borne by the member himself/herself.
③ Members may not use materials posted on the website commercially, such as processing and selling information obtained by using the Services.

Article 13. Ownership of SITMMT
① SITMMT owns the intellectual property rights and other rights related to the Services it provides and the software, images, marks, logos, designs, service names, information, trademarks, etc., necessary to offer these Services.
② Except where expressly authorized by SITMMT, a member may not modify, borrow, lend, sell, distribute, produce, transfer, relicense, establish security rights, and commercially use all or part of each property specified in Paragraph 1 and may not allow a third party to do so.

Chapter 4. Duties of Contracting Parties

Article 14. Duties of Members & Information Security
① When signing up to use the Services, members must provide complete information that conforms to the current information (hereinafter "Registration Information"). If a change occurs to the Registration Information, they must immediately renew the information.
② When members complete the process of signing up to use the Services, they will receive an ID and password. They must do the following to keep their IDs and passwords safe.
1. If their IDs or passwords are used without consent, they must immediately report it to the Seoul Metropolitan Government; provided, however, that if deemed necessary for the operation of the event, the administrator may act on their behalf.
2. They must make sure to log out at the end of each connection.
③ Members agree not to do the following while using the Services.
1. Harming others (including minorities)
A. Misappropriating a third party's ID and password, or pretending to be a third party
B. Falsely specifying a relationship with a third party
C. Damaging the reputation of a third party by stating facts or false facts for the purpose of slandering the third party
D. Circulating false information for the purpose of giving property benefits to oneself or a third party or damaging a third party
E. Obstructing another person's daily life by continuously reaching the person with words, sounds, texts, images, or videos that arouse shame, disgust, or fear
F. Engaging in profit-making activities by using the Services without prior consent from SITMMT
G. Misappropriating a third party's information and communication service name
2. Posting unnecessary or unauthorized advertisements or promotions; or soliciting, posting, publishing, or emailing junk mails, spam mails, chain letters, wallpapering messages, pyramid selling organizations, etc.
3. Posting, publishing, or emailing vulgar or obscene data, texts, software, music, photos, graphics, video messages, etc. (hereinafter "Contents")
4. Posting, publishing, or emailing contents without rights (all rights, including intellectual property rights)
5. Posting, publishing, or emailing software viruses to destroy or obstruct computer software, hardware, and telecommunications equipment, or to limit their functions
6. Collecting or saving another user's personal information, such as by posting, publishing, or emailing materials that contain other computer codes, files, or programs
7. Engaging in gambling or speculative activities by betting on properties
8. Circulating information that solicits prostitution or mediates obscene activities
9. Engaging in any other illegal or unfair activities
④ Members must comply with these Terms of Use and the matters stipulated by relevant laws and regulations.

Article 15. Duties of SITMMT
① Unless there are special circumstances, SITMMT shall make the Services available from the date members requested that the Services begin to be provided.
② SITMMT has the obligation to provide the Services in a continuous and reliable manner as set forth in these Terms of Use.
③ If a member suffers damages due to the Services provided by SITMMT, it shall bear responsibility only when such damages are caused by its intention or gross negligence, and the scope of such responsibility shall be limited to normal damages.
④ SITMMT must promptly handle opinions or complaints brought by a member if it deems them justified; provided, however, that if it is difficult to do so, SITMMT must notify the member of the reason and the schedule for handling them.
⑤ SITMMT shall strive to protect the personal information of members, including their registration information, pursuant to applicable laws and regulations. It shall observe applicable laws and regulations and the details presented in Article 16 with regard to protecting the personal information of its members.

Article 16. Privacy Policy
① SITMMT shall collect member information based on information provided by the member himself/herself when requesting to use the Services and shall use such personal information to fulfill this Service User Agreement and provide the Services under this Agreement.
② SITMMT shall not disclose or distribute member information obtained from the provision of the Services to a third party without his/her consent nor shall it use the information for commercial purposes; provided, however, that this shall not apply in any of the following cases.
1. If the information is requested from relevant agencies for investigative purposes pursuant to relevant laws and regulations
2. If the information is requested by the Korea Communications Standards Commission
3. If the information is requested otherwise according to the procedures set forth under relevant laws and regulations

Chapter 5. Termination of Agreement

Article 17. Termination of Agreement & Restriction on Use
① If a member wishes to terminate the Service User Agreement, the member himself/herself must access the internet and make a termination request on SITMMT's website.
② SITMMT may request to change or change a member's password for reasons such as security, account policy, and seamless provision of Services.
③ SITMMT may terminate the Service User Agreement without prior notice if a member has committed any of the following.
1. If the data provided by the member is found to be false
2. If the member is involved in criminal activity
3. If the member plans to use or uses the Services to undermine national interest or social public interest
4. If the member has misappropriated a third party's service ID or password
5. If the member damages the reputation of a third party or causes him/her disadvantages
6. If the member hinders a decent use of the Services, such as by damaging the Services
7. If the member otherwise violates applicable laws and regulations or the conditions for use set forth by the Seoul Metropolitan Government

Chapter 6. Miscellaneous

Article 18. Charges & Paid Information
Service use is essentially free of charge.

Article 19. Prohibition of Assignment
Members may not assign or grant their right to use the Services or other status under the Service User Agreement to others nor provide such right or status as a security.

Chapter 7. Compensation for Damages, Etc.

Article 20. Compensation for Damages
Except where damages are attributable to its gross negligence, SITMMT shall not be liable even where damages are incurred to members in relation to the Services provided free of charge.

Article 21. Exemption
① If SITMMT is unable to provide the Services due to natural disasters or any other events of equivalent force majeure, it shall be exempt from the responsibility of service provision.
② SITMMT shall not be responsible for any obstacles to service use caused by reasons attributable to the members themselves.
③ SITMMT shall not be responsible for the profit members expect to make by using the Services or damages incurred from materials obtained through the Services.
④ SITMMT shall not be responsible for the reliability and accuracy, among other things, of the information, data, and facts posted by members on the website.

Article 22. Jurisdiction
① If a dispute arises between SITMMT and a member regarding the use of the Services, both parties shall make all necessary efforts to resolve the dispute amicably.
② Notwithstanding the provisions of Paragraph 1, if a lawsuit is filed concerning the dispute, the competent court shall be the court having jurisdiction over the area the Seoul Metropolitan Government is located.

Addendum
(Effective Date) These Terms of Use shall apply as of December 15, 2019.
You have to right to refuse to accept the above Terms of Use,
but this may in part limit your seamless use of our Services.

SITMMT entrusts the handling of personal information to the external specialized company below in order to facilitate business performance, such as providing better services, offering customer convenience, etc. The handling of personal information is entrusted by service to the said company only when necessary to process individual services.
